This Privacy Policy describes how Artivia (the "Site", "we", "us", or "our"), collects, uses, and discloses your personal information when you visit, use our services, or make a purchase from artivia.online (the "Site") or otherwise communicate with us regarding the Site (collectively, the "Services"). We serve customers in the United States and Canada, and this policy is written to meet the requirements of both. For purposes of this Privacy Policy, "you" and "your" means you as the user of the Services, whether you are a customer, website visitor, or another individual whose information we have collected pursuant to this Privacy Policy.

What Personal Information We Collect

The types of personal information we obtain about you depends on how you interact with our Site and use our Services. When we use the term “personal information”, we are referring to information that identifies, relates to, describes or can be associated with you.

Information We Collect Directly from You

  • Contact details including your name, address, email address, and phone number.

  • Order information including your billing address, shipping address, and the items you purchase.

  • Gift information including any gift message you ask us to print and any special date you choose to share for delivery timing.

  • Customer support information including the content of messages and photographs you send us regarding a return or damage claim.

  • Marketing preferences including your email subscription status and consent record.

We do not receive or store your full payment card number. Card payments are processed directly by our payment providers, including Shopify Payments, Shop Pay, and PayPal, under their own security standards. We receive only confirmation of payment and limited details such as card type and the last four digits.

Information We Collect through Cookies

We also automatically collect certain information about your interaction with the Services (“Usage Data”). To do this, we may use cookies, pixels, and similar technologies (“Cookies”). Usage Data may include information about how you access and use our Site and your account, including device information, browser information, IP address, network connection, information about your interaction with the Site, and information about the site or advertisement that referred you to us.

Information We Obtain from Third Parties

We may obtain information about you from third parties, including vendors and service providers who collect information on our behalf, such as our store platform (Shopify), our payment processors, our shipping carrier (DHL) and any customs broker, and our analytics and advertising providers. How We Use Your Personal Information

  • Providing Products and Services. We use your personal information to provide you with the Services, including to process your payment, print your message card, pack and fulfil your order, arrange shipping, provide tracking, and to handle returns, exchanges, and damage claims.

  • Marketing and Advertising. We use your personal information for marketing and promotional purposes, such as to send marketing and promotional communications by email, and to show you advertisements for products or services on platforms such as Meta (Facebook and Instagram) and Google. We send marketing email only to people who have given consent, and every marketing email contains an unsubscribe link that works immediately and free of charge. In Canada, if you have purchased from us, we may send you occasional messages about similar products under the implied-consent rules; you may opt out at any time.

  • Security and Fraud Prevention. We use your personal information to detect, investigate, or take action regarding possible fraudulent or illegal activity, and to protect the safety of our customers and our business.

  • Communicating with You. We use your personal information to provide you with customer support, to send order confirmations, shipping notifications, delivery updates and delay notices, and otherwise to communicate with you about your order.

  • Legal and Tax Obligations. We use your personal information to meet our record-keeping, tax, and customs obligations, and to respond to lawful requests.

Cookies

Like many websites, we use Cookies on our Site. We use Cookies to power and improve our Site and our Services, including to remember your actions and preferences, and to understand how visitors use our store. The services we use are Shopify (store and cart functionality), Meta Pixel and Conversions API (advertising measurement), Google Analytics 4 (aggregate site statistics), and Microsoft Clarity (anonymised session and heatmap data, with payment and checkout fields masked).

You can control Cookies through the consent banner on our Site and through your browser settings. Please note that removing or blocking Cookies can negatively impact your user experience and may prevent the Site or checkout from working correctly.

We do not sell your personal information for money.

User Generated Content

The Services may enable you to post product reviews or other content. Any content you submit may be publicly displayed. Reviews shown on our store come from verified customers of our products, and where a review originates from another sales channel, that is disclosed. We do not publish fabricated reviews or invented ratings.

Third Party Websites and Links

Our Site may provide links to websites or other online platforms operated by third parties. We are not responsible for the privacy or security of, or information collected by, these third parties, and we encourage you to review their privacy policies.

Children's Data

The Services are not intended to be used by children, and we do not knowingly collect any personal information about anyone under 18. If you are the parent or guardian of a child who has provided us with personal information, you may contact us using the details below to request its deletion.

Security and Retention of Your Information

Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee “perfect security”. Our Site runs over an encrypted connection, payment processing is handled by PCI-compliant providers, and access to customer information is limited to team members who need it. In addition, information you send to us may not be secure while in transit.

How long we retain your personal information depends on factors such as whether we need it to maintain your order records, to comply with legal obligations, or to resolve disputes. Order and transaction records are kept for at least seven years for tax, customs, and accounting purposes. Customer service messages are kept for up to three years after your last contact. Marketing subscriber records are kept until you unsubscribe, together with a record of the unsubscribe so that we honour it.

  • Right to Delete. You may have a right to request that we delete personal information we maintain about you, subject to records we are required by law to keep.

  • Right to Correct. You may have a right to request that we correct inaccurate or incomplete personal information.

  • Right of Portability. You may have a right to receive a copy of your personal information in a structured, commonly used, machine-readable format.

  • Right to Withdraw Consent. Where we rely on consent, you may withdraw it at any time, including consent for marketing email.

  • Right to Opt Out of Targeted Advertising and Sharing. You may ask us to stop sharing your personal information with advertising platforms for personalised advertising.

  • Right of Non-Discrimination. You have the right not to receive discriminatory treatment for exercising any of these rights. We will never charge you a different price or provide a lesser service.

We may need to verify your identity, usually by confirming details of an order you placed. You may authorise an agent to submit a request on your behalf; we will require proof of that authorisation.

If you are not satisfied with our response, you may have the right to complain to your privacy regulator: in Canada, the Office of the Privacy Commissioner of Canada or your provincial authority, including the Commission d’accès à l’information for Quebec residents; in the United States, your state attorney general.

International Users

We operate from the United States, and our service providers store and process information in the United States and other countries. If you are located in Canada, this means your personal information is transferred to and stored in the United States, where it may be accessible to U.S. courts, law enforcement, and national security authorities under U.S. law.
